1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of the Outkomes website and services ("Outkomes," "Service," "we," "us," or "our").

By accessing or using Outkomes, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the Service.

2. About Outkomes

Outkomes provides tools and information for exploring prediction markets, market data, traders, trading activity, news, events, and related statistics and analytics.

Features may include market discovery, market screeners, charts, market metrics, trader profiles, leaderboards, live trading activity, event calendars, news, comments, and other tools that we may introduce or modify over time.

3. Eligibility

You may use Outkomes only if you are legally permitted to do so under the laws applicable to you.

Certain prediction-market platforms, financial products, or other services referenced by Outkomes may have their own eligibility, geographic, age, or other restrictions. You are responsible for complying with those requirements.

4. Accounts

Certain features may require an account. When creating an account, you agree to provide accurate information and keep your account information reasonably up to date.

You are responsible for maintaining the security of your account and for activity that occurs through your account. You should notify us promptly if you believe your account has been compromised.

5. Market Data and Third-Party Information

Outkomes displays information obtained from third-party platforms, public sources, data providers, and other sources. This may include market prices, probabilities, trading activity, order books, volume, liquidity, open interest, trader statistics, market metadata, event information, and news.

We make reasonable efforts to provide useful and timely information, but we do not guarantee that information displayed on Outkomes is accurate, complete, current, or error-free.

Third-party data may change, become unavailable, contain errors, or be delayed. Outkomes is not responsible for inaccuracies or interruptions originating from third-party sources.

6. No Financial or Investment Advice

Outkomes provides information, data, analytics, and tools for informational and research purposes only.

Nothing on Outkomes constitutes financial advice, investment advice, trading advice, legal advice, tax advice, or a recommendation to buy, sell, trade, or participate in any prediction market or other financial product.

You are solely responsible for your own decisions and should conduct your own research and, where appropriate, seek advice from qualified professionals.

7. Third-Party Platforms

Outkomes may reference or display information relating to third-party platforms, including Polymarket, Kalshi, and other prediction-market or financial platforms.

Outkomes is not necessarily affiliated with, endorsed by, or operated by those third parties unless explicitly stated.

Your use of any third-party platform is governed by that platform's own terms, policies, and requirements. Outkomes is not responsible for third-party platforms or transactions conducted through them.

8. News and Editorial Content

Outkomes may aggregate, link to, summarize, or publish news and other editorial content relating to prediction markets, current events, and other topics.

News and editorial content is provided for informational purposes and may contain errors, opinions, or information that changes over time. Third-party content remains the responsibility of its respective publisher.

9. User Content and Comments

If Outkomes provides features allowing you to submit comments or other content, you are responsible for the content you submit.

You agree not to submit content that is unlawful, fraudulent, threatening, abusive, defamatory, infringing, excessively disruptive, or otherwise inappropriate for the Service.

By submitting content to Outkomes, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that content as reasonably necessary to operate and provide the Service.

We may remove content that violates these Terms or that we reasonably believe is harmful to the Service or its users.

10. Acceptable Use and Data Restrictions

You may use Outkomes for your own personal, informational, research, and other lawful purposes, subject to these Terms. You may not use the Service in a way that interferes with its operation or attempts to extract, reproduce, or commercially exploit Outkomes or its data without our permission.

Without limiting the foregoing, you may not:

• Scrape, crawl, spider, harvest, or otherwise systematically collect data or content from Outkomes using automated means.
• Use bots, scripts, automated requests, or other automated methods to access or interact with Outkomes in a manner that exceeds reasonable use or bypasses technical restrictions.
• Circumvent, disable, defeat, or otherwise interfere with rate limits, access controls, authentication systems, security measures, or other technical restrictions.
• Systematically copy, reproduce, mirror, republish, or redistribute substantial portions of Outkomes, including its databases, market lists, trader data, analytics, rankings, or other proprietary content.
• Use Outkomes data to create, maintain, train, populate, or operate a competing database, product, service, website, or application without our prior written permission.
• Resell, sublicense, lease, distribute, or commercially exploit substantial portions of data or content obtained from Outkomes without our prior written permission.
• Use automated methods to bulk-download or systematically extract market data, trader information, news, statistics, or other information from the Service.
• Access or use an API except through an API or other programmatic interface that we have expressly made available for that purpose and in accordance with any applicable API terms or limits.
• Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code or underlying technology of Outkomes, except to the extent that applicable law expressly permits such activity.
• Use information obtained from Outkomes to impersonate another person or entity or to misrepresent its source.
• Use the Service in a manner that could damage, overload, impair, or interfere with Outkomes or its infrastructure.
• Use the Service for unlawful purposes or in violation of applicable laws or regulations.

Nothing in these Terms prohibits lawful activities that cannot legally be restricted, including uses of information that is in the public domain or rights that cannot be waived under applicable law.

11. Intellectual Property

Outkomes and its original content, software, design, branding, logos, and other materials are owned by or licensed to Outkomes and are protected by applicable intellectual property laws.

These Terms do not grant you ownership of Outkomes or its intellectual property. You may use the Service only as permitted by these Terms.

Third-party trademarks, logos, market data, and other materials remain the property of their respective owners.

12. Availability and Changes

We may modify, suspend, discontinue, or restrict any part of Outkomes at any time. Features may change as we develop and improve the Service.

We do not guarantee that Outkomes will always be available, uninterrupted, secure, or error-free.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUTKOMES IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

We do not warrant that information provided through Outkomes will be accurate, complete, current, reliable, or suitable for any particular purpose.

We are not responsible for decisions made based on information displayed through the Service, including decisions involving prediction markets, trading, investments, or other financial activities.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Outkomes and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or business arising from or related to your use of the Service.

To the maximum extent permitted by law, our total liability arising from or relating to the Service will be limited to the amount you paid to Outkomes for the Service during the applicable period, if any.

Some jurisdictions do not allow certain limitations of liability, so some portions of this section may not apply to you.

15. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Outkomes and its owners, operators, employees, contractors, and service providers from claims, liabilities, damages, losses, and expenses arising from your unlawful use of the Service, violation of these Terms, violation of another person's rights, or content you submit through the Service.

16. Termination

We may suspend or terminate access to Outkomes if we reasonably believe that you have violated these Terms, misused the Service, created security or legal risks, or otherwise engaged in conduct that may harm Outkomes or its users.

You may stop using Outkomes at any time.

17. Governing Law

These Terms will be governed by the laws of Hong Kong, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.

Any dispute-resolution provisions and the appropriate jurisdiction for legal proceedings should be finalized based on the legal entity operating Outkomes and the jurisdiction in which it is organized.

18. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of Outkomes after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by law.
